GENERAL TERMS AND CONDITIONS

1. Scope of Application, Severability Clause:
1.1 The following General Terms and Conditions (“GTC”) apply to all consumers or entrepreneurs (hereinafter referred to as “Members”) who use the online services of gehgassi GmbH (accessible at: https://www.gehgassi.com). By using the platform, Members accept these GTC and all relevant legal provisions and assume responsibility and liability for compliance. gehgassi GmbH offers its services solely based on these GTC, which shall remain valid for all future transactions until revoked, in the latest version dated December 18, 2024.
1.2 Deviations, amendments, or additions to these GTC require written form, including any waiver of this requirement. Contradictory terms from Members will not be accepted.
1.3 If any provision of these GTC is or becomes invalid due to mandatory legal provisions, the remaining terms shall remain unaffected.
1.4 Members may save and print these GTC at any time as a PDF.
2. Contracting Party and Conclusion of Contract:

2.2 gehgassi GmbH operates a mobile app for matching dog walkers/sitters with dog owners in Austria. gehgassi GmbH acts solely as a mediator and is not party to contracts concluded between Members. All agreements are made directly between Members, and gehgassi GmbH is held harmless from any claims arising from such agreements. The company provides only the technical platform and does not guarantee success in matchmaking or performance outcomes.
3. Registration:
3.1 App usage requires registration. Members must confirm they are over 18 and legally capable of entering a contract. Personal data (name, email, address, phone number) must be accurate and updated when necessary. Members agree to be contacted for app development and support purposes.
Registration is completed only after accepting the GTC and Privacy Policy via checkbox. Without this consent, registration and app usage are not possible. By registering, Members also agree to the collection and processing of their personal data as per the Privacy Policy.
Third-party terms (e.g., other GTCs) will not become part of the contract, even if gehgassi GmbH is aware of them.
Members must also complete a CAPTCHA (provided by reCAPTCHA Inc.) to verify human input.
3.2 After successful registration, Members receive login credentials via email or SMS. A user profile can then be created, including optional abbreviated personal details and pet profiles or service qualifications (for walkers/sitters). After profile setup, Members can view others, search for local services, and book walks or offer their own services. Contracts are formed solely between Members.
4. Subscriptions and Costs:
4.1 Full app functionality (e.g., chat, booking) requires a paid subscription:

Monthly: €3.99/month

Annual: €19.99/year
4.2 Payment is processed via the respective app store (Google Play/Apple App Store), which also handles cancellations. gehgassi has no control over this process.
4.3 Subscriptions auto-renew unless canceled at least one (1) day before expiry. Renewals trigger a new charge. Members can choose to receive renewal reminders via email.
4.4 Refunds are excluded unless required by law.
4.5 gehgassi may change subscription prices at any time. Price changes take effect from the next billing period and are announced via app store or in-app notifications.
5. Rights and Obligations of Members:
5.1 Members may offer or book dog walking/sitting services via the app. If initial contact occurs via the app, bookings must also be made through the app. Violations may incur a €25.00 penalty fee.
5.2 Members must not:

Share third-party data from the platform without consent

Use the platform for illegal or GTC-violating purposes

Insult, deceive, defraud, or commit crimes against others

Copy, alter, or mimic the platform for competitive purposes

Share unlawful or immoral content
5.3 gehgassi GmbH may suspend or delete Member accounts at any time without explanation or prior notice. No entitlement to registration exists.
5.4 Content violating the GTC may be removed without explanation.
5.5 gehgassi may modify, limit, or terminate platform features at any time without notice.
6. Disclaimer of Liability:
6.1 gehgassi encourages careful user descriptions but cannot guarantee reliability or conduct. Members agree to indemnify gehgassi from all claims relating to platform activity or user content.
6.2 No liability is accepted for the accuracy of user data or qualifications.
6.3 Users are fully responsible for the content they share and any resulting legal violations.
6.4 Compliance with employment, tax, social insurance, and related laws (including obtaining necessary insurance) is the sole responsibility of Members.
6.5 gehgassi is not liable for non-performance of agreements between Members and does not offer replacement services.
7. Paid Services Payment Processing:
7.1 Members may offer services for self-determined or mutually agreed fees.
7.2 Payments are processed via:

7.3 Members must accept each provider’s terms to use the payment service:

MANGOPAY: Credit card, Maestro, Giropay, Przelewy24, iDEAL, Bancontact

PayPal: PayPal balance, credit card, SEPA direct debit
7.5 Members bear all associated transaction fees.
7.6 Payment must occur before services are rendered. Funds are released after successful service completion.
7.7 gehgassi is not liable for payment issues; members must contact the respective provider:

7.8 A service fee applies:

€1.00 if fee ≤ €100.00

€10.00 if fee > €100.00
7.9 Members must ensure payment methods are valid. Late payments may incur 4% interest and €10.00 late fees.
7.10 All payments are exclusively processed via MANGOPAY or PayPal. gehgassi is not responsible for their data security or errors.
8. Online Shop for Advertising Partners:
8.1 gehgassi offers advertising opportunities on its website and app.
8.2 Advertisers receive access to a portal to plan and book ads independently.
8.3 Listings last one year unless otherwise agreed. Early termination is not possible.
8.4 Listings can be purchased via the website. Offers are non-binding invitations.
8.5 Submitting the online form constitutes a binding offer. gehgassi only contracts with businesses per §1 UGB. Consumers are excluded.
8.6 The contract is concluded once gehgassi accepts the offer within 7 working days via invoice. If not accepted, the offer is deemed rejected.
8.7 After full payment, access is granted to the advertising portal. Advertisers are solely responsible for ad content. gehgassi may remove content that violates laws or its own interests.
9. Right of Withdrawal:
9.1 Consumers per §1 KSchG may cancel a distance contract within 14 days without reason (§11 FAGG).
9.2 The withdrawal period begins upon contract conclusion.

The deadline is met if the declaration is sent before it expires.
9.4 Upon withdrawal, payments must be refunded within 14 days using the same payment method, free of charge. gehgassi is not liable for MANGOPAY delays.
9.5 If services were used during the withdrawal period, an appropriate fee will be charged. Full services rendered are non-refundable.
9.6 Consumers will receive confirmation of the contract on a durable medium (email or SMS) before services begin or shortly after, per §7(3) FAGG.
